TRANSIENT RENTALS IN KEY WEST

Some say the issue is "moot." Others say it is not.
Looking at recent history, with the "legalization" of transient rentals in the HPRD zone
(Truman Annex), we're inclined to say the issue is NOT MOOT in Key West,
despite a recent Florida Supreme Court ruling concerning the Monroe County Ordinance.

Current litigation may well lead to more "legalization," not just in Old Town but all over
the Island. Once it's done, that's it. It can't be "undone."

If you want to preserve real estate values in your neighborhood, maintain a sense of
(relative) security, and be assured that you won't be awakened by partying strangers staying
in adjacent properties, then it might not be a bad idea to ask your Commissioner about his
feelings on this issue.

LEAD US TO BELIEVE THAT RESIDENTIAL HOMEOWNERS
REALLY DO HAVE A PROBLEM.

THEY KEPT DENYING THERE WOULD BE ANY CHANGES, THEN THEY
"LEGALIZED" TRANSIENT RENTALS IN THE ANNEX!

FACT: THE DECISION SEEMS TO INDICATE THAT ALL ONE
WOULD NEED WOULD BE A NON-TRANSIENT LICENSE IN
EFFECT SINCE 1998 AND THE ARGUMENT THAT THEY RELIED
ON THE "FORMER TRANSIENT DEFINITION."

FACT: NO ONE KNOWS HOW MANY OF THESE "50% RULE"
OPERATIONS WILL BECOME LEGAL, OR WHERE THEY ARE
LOCATED.

FACT: THE CITY HAS NOT BEEN EFFECTIVE IN ENFORCING THE
ZONING WITH REGARD TO PUBLIC RENTALS.

FACT: THE CITY WEAKENED IT OWN ENFORCEMENT OPTIONS
BY AN ORDINANCE THEY PASSED IN FEBRUARY 2003.


FACT: MANY OF THE LEGALLY LICENSED TRANSIENT RENTALS
IN RESIDENTIAL ZONES ARE NOW RUN BY REGULAR HOTELS
AND LODGING ESTABLISHMENTS. THEY ARE IN NO WAY
"RESIDENTIAL"; THEY'RE COMMERCIAL OPERATIONS.

FACT: TRANSIENT RENTALS INTERSPERSED WITH REGULAR
HOUSING HAVE CAUSED FRICTION WHEREVER THEY HAVE
OCCURRED.
THOSE ARE THE FACTS.

WE URGE EVERYONE TO KEEP THEIR EYES OPEN AND
FORM YOUR OWN OPINION. BEFORE LONG THEY WILL
TRY TO GIVE UP THE REST OF OLD TOWN.

MANY OF US REALIZE THAT A MONTHLY RENTAL
ATTRACTS A MORE SEDATE CROWD, AND CAUSES LESS
DISRUPTION IN OUR CROWDED NEIGHBORHOODS.
CAN ANYBODY DO ANYTHING ABOUT IT?
WILL SOMEONE OPEN A HOTEL NEXT TO YOU???
